Privacy Policy

1. Introduction

This privacy policy provides information on how IQAir Holding AG and its associated companies IQAir AG Steinach, IQAir Asset Management GmbH Wangen, IQAir Germany GmbH Wangen (hereinafter referred to as "IQAir Group", "we" or "us") collect and process personal data.
This is not an exhaustive description; at most, other privacy policies or general terms and conditions regulate specific issues. Personal data is understood to mean all information relating to an identified or identifiable person.

If you provide us with personal data of other persons (e.g. family members, work colleagues), please ensure that these persons are aware of this Privacy Policy and only provide us with their data if you are authorized to do so and the information is correct.

This Privacy Policy is designed to meet the requirements of the revised Swiss Data Protection Act ("FADP") and the EU General Data Protection Regulation ("GDPR"). Whether and to what extent these laws are applicable depends on the individual case.

3. Collection and processing of personal data

We primarily process the personal data that we collect in the context of our business relationships with customers, suppliers, applicants and other business partners or in the operation of our websites, apps and other applications. This also includes data collected in the context of the use of the Career Page and the recruiting service "Onlyfy" (see para. 4).

Where permitted, we also obtain data from publicly available sources or from third parties (e.g. authorities, service providers or other companies in the IQAir Group). The categories include, among other things, contact and identification data, information on professional functions, communication and application documents, technical usage data (e.g. IP address, device information, cookies, access times, location information) as well as information from media and internet sources, insofar as this is appropriate in the individual case (e.g. in the context of an application).

4. Purposes of data processing and legal basis

We use personal data to fulfil contractual obligations, to process business relationships, to comply with legal obligations and on the basis of legitimate interests.

In addition to the purposes described in the General Privacy Policy, this includes, in particular, the following additional processing activities within the framework of the Career Page.

4.1 Processing of job seekers and applications (Onlyfy)

If you apply for a job via the IQAir Career Page, your details and documents will be processed via the Onlyfy (by NewWork SE) service.

Onlyfy supports IQAir in managing and processing applications. In particular, the following data is collected and processed:

  • Master data (e.g. name, address, contact details),
  • Application documents (e.g. curriculum vitae, certificates, cover letter),
  • Correspondence and notes in the application process.

The processing is carried out exclusively for the purpose of reviewing and handling the application process, internal decision-making and communication with you.

The legal basis is the implementation of pre-contractual measures and, if necessary, your consent (e.g. in the case of voluntary additional information).

4.2 Evaluations of the website usage using Google Analytics

We use Google Analytics (a service of Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland) for the statistical evaluation of visitor behaviour on our website.

Google uses cookies or similar technologies to collect information about the use of our website, such as which pages are accessed, how long they are visited, or which sources users use to access our website. This data helps us to better understand the use of our website and to continuously optimize our online offering.

The legal basis is our legitimate interest in analysing and improving our website. If you consent to the use of analysis cookies, the processing is based on your consent, which you can revoke at any time.

Data may be transferred to countries outside Switzerland and the EU (e.g. to the USA). Google uses standard contractual clauses to ensure an appropriate level of data protection.

5. Use of Cookies and Tracking Technologies

6. Data transfer and data transfer abroad

In connection with the above-mentioned purposes (in particular recruiting via Onlyfy and online marketing via Google Ads), personal data may be transmitted to external service providers in Switzerland, within the European Union and to third countries.

If recipients are located in countries without an adequate level of data protection, we ensure that your data is adequately protected by means of appropriate safeguards (e.g. EU standard contractual clauses).

7. Duration of retention of personal data

We process and store your personal data for as long as it is necessary for the fulfilment of our contractual and legal obligations or otherwise the purposes pursued by the processing, i.e. for example for the duration of the entire business relationship (from the initiation and settlement to the termination of a contract) as well as beyond that in accordance with the statutory retention and documentation obligations. It is possible that personal data will be retained for the time in which claims can be asserted against our company and if we are otherwise legally obliged to do so or if legitimate business interests require this (e.g. for evidentiary and documentation purposes). As soon as your personal data is no longer required for the above-mentioned purposes, it will be deleted or anonymised as a matter of principle and as far as possible.

8. Obligation to provide personal data

As part of our business relationship, you must provide the personal data that is necessary for the establishment and implementation of a business relationship and the fulfilment of the associated contractual obligations (as a rule, you do not have a legal obligation to provide us with data). Without this data, we will not normally be able to enter into or perform a contract with you (or the entity or person you represent). The website cannot be used if certain information to ensure data traffic (such as IP address) is not disclosed.

9. Rights of the data subject

Within the framework of the data protection law applicable to you and to the extent provided for therein (such as in the case of the GDPR), you have the right to information, correction, deletion, the right to restriction of data processing and otherwise to object to our data processing, in particular for the purposes of direct marketing and other legitimate interests in the processing as well as to the release of certain personal data for the purpose of transfer to another body (so-called data portability). Please note, however, that we reserve the right to enforce the restrictions provided for by law, for example if we are obliged to store or process certain data, have an overriding interest in doing so (insofar as we may invoke it) or need it for the assertion of claims. If you incur any costs, we will inform you in advance. We have already discussed the possibility of revoking your consent in No. 7. Please note that the exercise of these rights may conflict with contractual agreements and this may have consequences such as early termination of the contract or cost consequences. We will inform you in advance if this is not already contractually regulated.

The exercise of such rights usually requires you to provide clear proof of your identity (e.g. by means of a copy of your ID, where your identity is otherwise not clear or cannot be verified). To assert your rights, you can contact us at the 1 contact the address provided.

Every data subject also has the right to enforce his or her claims in court or to lodge a complaint with the competent data protection authority.  The competent data protection authority in Switzerland is the Federal Data Protection and Information Commissioner (http://www.edoeb.admin.ch).

The current version of this privacy policy is published on this website. The IQAir Group reserves the right to amend this privacy policy at any time.
